Orengo: Dismissal of Bob Njagi’s treason charges is a victory for justice
Siaya Governor James Orengo has described the dismissal of treason charges against activist Bob Njagi by the Kajiado Law Courts as a victory for justice and the rule of law, following a ruling that ended a politically charged case that had drawn national attention.
In a post on Thursday, July 2, 2026, shortly after the decision at Kajiado Law Courts, Orengo welcomed the court’s finding that the prosecution, led by the Directorate of Criminal Investigations (DCI), had failed to establish a prima facie case.
“Today’s dismissal of treason charges against Bob Njagi by the Kajiado Law Courts is a victory for the rule of law. We commend the court for upholding its integrity and resisting political manipulation,” Orengo wrote on X.

He further stressed that the ruling reinforced constitutional protections for free expression and assembly, arguing that no citizen should face criminal sanctions for political speech.
“No Kenyan should face trumped-up charges for exercising their democratic rights. Bob Njagi’s arrest is a political injustice to the entire nation,” he added.
Orengo was part of Njagi’s defence team alongside Embakasi East MP Babu Owino, Senator Dan Maanzo, and advocate Erick Ngunjiri.
In court, the magistrate ruled that the prosecution had not presented sufficient evidence to sustain treason charges, leading to the formal dismissal of the case and closure of the file.

The ruling also followed a period in which Njagi had been held at Isinya Police Station for more than a week while investigators gathered material.
Njagi was arrested in Kajiado County on June 24 over allegations of incitement linked to the June 25 Gen Z anniversary demonstrations. Prosecutors had argued that a video circulating on social media showed him urging young people to participate in protests, claims the defence dismissed as protected political expression.
The court ultimately found that the evidentiary threshold for treason had not been met.

Following the ruling, Embakasi East MP Babu Owino confirmed the outcome in a statement, urging law enforcement agencies to ensure they gather sufficient evidence before bringing charges.
“Today at Kajiado Law Courts we represented activist Bob Njagi who was charged with treason. The court found that the case had no merit and dismissed it,” Owino said.
Njagi’s release has reignited debate over arrests linked to recent protests and the broader treatment of activists.
Orengo, who was present during the proceedings, maintained that the judiciary had demonstrated independence at a critical moment, adding that the decision should serve as a warning against the politicisation of criminal charges in Kenya’s evolving democratic landscape.
