Senate seeks compliance report on disability inclusion in public service

The Senate has intensified calls for accountability in the public service as Senator George Mbugua (Nominated) sought a comprehensive compliance report on the implementation of the five per cent employment quota for persons with disabilities.

Senator Mbugua, in a statement presented in Parliament, asked the Standing Committee on Labour and Social Welfare to provide detailed data on the representation of persons with disabilities across Ministries, State Departments, State Corporations, and other public institutions.

He requested the information to be disaggregated by institution, job cadre, gender, and county, in line with Article 54(2) of the Constitution and the Persons with Disabilities Act, 2025.

The senator asked for a breakdown of current staffing levels for persons with disabilities across public institutions and clarification on challenges affecting the achievement of the five per cent employment threshold.

He also sought details on corrective actions being undertaken, capacity-building initiatives, enforcement mechanisms, and government targets with timelines for full implementation.

Mbugua further requested clarification on whether public institutions are required to submit periodic reports on disability inclusion and the level of compliance with reporting obligations.

This comes amid renewed pressure from Nominated Senator Crystal Asige, who has been at the forefront of advocating for the full operationalisation of the Persons With Disabilities Act, 2025, as stakeholders continue to push for the gazettement of regulations needed to implement key provisions on inclusion, employment quotas, accessible infrastructure, and social protection services.

Legal framework and policy requirements

Realisation: The Persons with Disabilities Act, 2025, requires integration of disability inclusion across key sectors, including education, health, employment, justice, infrastructure, and political participation. The law provides for progressive realisation of inclusive participation in public and private sectors.

Mbugua said the provisions require structured reporting and enforcement to ensure compliance with the constitutional requirement that at least five per cent of positions in elective and appointive bodies are reserved for persons with disabilities.

The Senate is expected to review the committee’s response as part of ongoing oversight on the implementation of disability inclusion policies in the public service.
