Public participation open as the Senate reviews mining Amendment bill 2025
The Senate of Kenya has invited members of the public to submit memoranda on the proposed Mining Amendment Bill, 2025 (Senate Bill No. 22 of 2025), as part of the constitutional requirement for public participation in the legislative process.
Inviting the public to submit the memoranda on a notice posted on their social media handles on Thursday, March 12, 2026, the parliament has noted that the bill was first read in the Senate Standing Committee on Lands, Environment and Natural Resources when it was issued as a public notice on February 26, 2026, and then sent to the committee to be considered.
The committee is required to ensure that citizens participate in the process and provide views and recommendations to the committee before submitting its report to the Senate, which shall be further debated.
“The Bill seeks to amend the Mining Act (Cap. 306) by establishing a comprehensive legal and administrative framework to guide the utilisation of mineral royalties by county governments and local communities.
“It further proposes mechanisms to ensure the prompt transfer of royalties allocated to county governments and local communities into county revenue funds to facilitate timely utilisation. In addition, the Bill provides for the establishment of community-led committees responsible for identifying and monitoring projects funded through these royalties,” the Parliament statement noted.

The bill has proposed mechanisms which, as per the committee, would see to the prompt transfer of mineral royalties to county governments and local communities. This money would be directly deposited into county revenue funds so that it can be used in development projects in an efficient and rapid manner.
The amendments also suggest the establishment of community-based committees that will be charged with the responsibility of monitoring and identifying the initiatives to be funded with the royalties. It is believed that the committees will improve accountability and see to it that the mining revenues are utilised to fund projects that directly affect the residents.
How to submit the memoranda
Individuals, civil society entities, and stakeholders in the mining industry have been invited by the Senate committee to write written memoranda on the proposed law, reflecting their opinion regarding the proposed law.

The submissions are to be directed to the Office of the Clerk of the Senate at the Parliament of Kenya, and they may be made by post, by hand to the Office of the Clerk at the Main Parliament Buildings in Nairobi or electronically through the e-mail.
