The Ethics and Anti-Corruption Commission (EACC) yesterday obtained orders preserving a  property in Loresho allegedly associated with Migori Governor Okoth Obado.

Justice Mumbi Ngugi  restrained the Migori  Governor, his daughter Everlyne Odhiambo Zachary and a businessman Jared Peter Kwaga  from selling,  disposing or in any way dealing with the property known as Loresho Ridge House  for six months. 

EACC in court documents claims the property was bought at Sh35 million funds embezzled from Migori County Government.

The Anti-graft body argues the property  is  registered in the name of Kwaga who incorporated many companies to trade with the Migori County Government. 

EACC however claims that the rent of  the said property  is paid  to the governor’s daughter Everlyne.

Evidence collected

“The evidence collected thus far leads me to believe that the 1st Respondent (Jared) is holding the property on behalf of the 3rd Respondent(Obado)  and I am advised by counsel on record that this arrangement constitutes a trust,” said EACC forensic Investigator Ann Murigi in an affidavit.

According to the anti-graft body, Investigations have established a pattern whereby firms associated with known proxies of the governor  including Kwaga, were systematically awarded high value contracts, between 2013 and 2017.

“Further investigations have established that Kwaga used the illicit wealth gained from fraudulent transactions with the County Government of Migori to acquire the said property,” claimed EACC in court documents.

Justice Ngugi certified the matter as urgent but declined to appoint an official receiver for purposes of preservation of rent accruing from the property Loresho saying the appropriate person had not written in the court documents. She directed EACC to make an application on the same.
