DPP approves manslaughter charges over South C building collapse

The Director of Public Prosecutions (DPP) has approved criminal charges against dozens of public officials, developers and professionals following the collapse of Manzil Towers in South C, Nairobi, on January 2, 2026.

In a statement issued on June 5, 2026, the Office of the Director of Public Prosecutions (ODPP) said it had reviewed a probe file submitted by the Directorate of Criminal Investigations (DCI) and determined that there was sufficient evidence and a realistic prospect of conviction to warrant prosecution.

“The Decision to Charge was made in strict compliance with Article 157 of the Constitution, the Office of the Director of Public Prosecutions Act, the Decision to Charge Guidelines, and based on the evidence presented by investigators,” the statement said in part.

Among those approved for prosecution is Patrick Analo Akivaga, who is set to face charges of abuse of office and neglect of official duty.

According to the ODPP, the proposed charges arise from findings contained in the investigation file relating to the approval, oversight and regulatory processes associated with the construction project before its collapse.

The ODPP said the decision followed what it described as an independent and thorough analysis of the evidence contained in the inquiry file.

Four individuals, Daniel Alphonse Odhiambo, Gideon Chege Mwangi, Abdishakur Muse Mohamed and Yussuf Mohamed Yussuf,  have been approved for prosecution on manslaughter charges.

The DPP also approved abuse of office charges against 37 individuals, including public officials and other persons linked to the project.

The same group is also set to face charges of neglect of official duty.

In addition, Gideon Chege Mwangi, Abdishakur Muse Mohamed and Yussuf Mohamed Yussuf have been approved for prosecution on charges of making a false document.

The ODPP further approved charges against Daniel Alphonse Odhiambo, Gideon Chege Mwangi, Abdishakur Muse Mohamed and Yussuf Mohamed Yussuf for allegedly commencing a project without an Environmental Impact Assessment licence.

According to the prosecution agency, the charges arise from findings made during investigations into the circumstances surrounding the collapse of the building.

 The ODPP said the accused persons will be arraigned in court to answer to the charges.

“The Office of the Director of Public Prosecutions (ODPP) reaffirms its commitment to upholding the rule of law, safeguarding the public interest, and ensuring accountability where criminal conduct is established through investigations.” ODPP said.

The charges are yet to be tested in court, where the accused persons will have an opportunity to respond to the accusations.
