10 Nyamira MCAs lose seats after missing eight sittings

Ten Members of Nyamira County Assembly who had been attending their sessions in Bunge Mashinani yesterday lost their positions for failing to attend eight consecutive sittings in the gazetted Assembly as required by the law. 

Among the 10 are two elected MCAs Nyambega Gisesa (Rigoma) and Joel Ombongi (Bokeira) who are all elected through the UPA party ticket whose party leader is Nyamira Governor Amos Nyaribo. 

Others affected are nominated MCAs Martha Marua (ANC), Janerose Nafula Nyakundi (ODM), Jeriah Nyakangi (UPA), Zipporah Matundura (Wiper), Elijah Abere (UPA), Edina Obara (UPA) and Beatrice Onyancha (UPA). 

Those who were also targeted but survived are Abel Mose (Magwagwa) and his Itibo ward counterpart Lameck Onyancha Nyakianga who were also slapped with a ban of missing seven and six sittings, respectively. 

Contravening powers 

The 10 were sent packing yesterday during a special sitting following a report by the powers and privileges committee under the chairmanship of Bonyamatuta MCA Julius Matwere which recommended the sacking of the MCAs for contravening the powers and privileges Act 2017. 

Making the ruling, Speaker Thadaus Nyabaro said that an official communication will be made to the Independent Electoral Boundaries Commission, declaring all the positions in question vacant. 

The affected MCAs are those allied to former Speaker Enock Okero. For the last eight months, they have been conducting their activities at Bunge Mashinani while the Nyabaro group has been holding their sittings in the assembly. 

Declared illegal 

Three weeks ago, the High Court sitting in  Bomet declared the Bunge Mashinani illegal, thus recognising the Nyabaro group, which was conducting its activities in the assembly. 

The court also ordered those conducting their sittings in Bunge Mashinani to be surcharged for money spent during the illegal sittings. 

Okero and his group have, however, moved to the Court of Appeal in Nakuru, challenging the Bomet ruling, and the matter is coming up for hearing on July 23, 2025. 

Ombongi and Nyambega who attended yesterday’s sitting laughed off the ruling, terming it ridiculous. 

Ombongi and Nyambega were targeted because they were the think tanks of Okero and Nyaribo. 

“This move is meant to create space so as to have Governor Amos Nyaribo impeached, but let them be told that the political wars have now started,” Ombongi told journalists. 

Nyamira County assembly has been in the news for having two assemblies, two speakers and two clerks and with the new development, it means the wrangles will continue to persist.
