Student fights agency over Sh102m account freeze order
A Nairobi Technical Institute student, whose bank account containing Sh102 million was frozen, will have to wait longer to access the funds after the High Court directed the matter be mentioned on January 26.
Justice Esther Maina directed Assets and Recovery Agency (ARA) to respond to the application, filed by Felista Nyamathira Njoroge within seven days, after which Njoroge will file submissions within three days.
Njoroge through lawyers Patrick Lumumba and Thomas Maosa, wants the court to set aside the orders issued on November 17, 2021, that froze her bank account for 90 days.
The 21-year-old college student accuses ARA of malice saying the agency did not seek any explanation from her regarding the funds in her account.
She claims ARA painted her in bad light by issuing press releases, yet no papers had been served with any document.
When the matter came up yesterday, ARA through lawyer Adow Mohammed sought more time to file their response.
ARA had applied to have Njoroge’s account frozen after suspecting that the millions were proceeds of money laundering despite being sent to her account by Belgian businessman Marc De Mesel, who is suspected to be her boyfriend.
The case will be mentioned on January 26 for further directions.
