Shooter of K’ Osewe Foods owner remanded for calling complainant animal

Milimani Magistrate Court on Monday remanded a man for 24 hours for referring to the complainant as an animal.
The Chief Magistrate Martha Mutuku said the accused Tom Oywa Mboya demeaned the court by use of vulgar language and remanded him until Tuesday Morning.
“You(Mboya)have used bad language that has violated the dignity of this court despite warning you severally. I can not allow a person to refer to another human being as an animal. I. Remand you until tomorrow morning so that you can rethink about the language to be used in court and also conduct as we proceed with this case,”said Mutuku.
The accused used the term during a cross examination by state prosecutor Anderson Gikunda on the shooting of the Complainant William Osewe.
In yet another incident, Mboya disrespected the court by chewing a candy without seeking the court’s permission. The court advised Mboya’s attorney to caution his client against disrespecting the court.

Mboya is accused of shooting William Osewe, the owner of K’ Osewe foods on suspicion that Osewe had an affair with his (Mboya) wife in 2016 at Garden Estate, Nairobi.
In his defence earlier, Mboya told the court that he shot twice in the air and then at Osewe’s right hand. Mboya had also told the court that he shot Osewe in self defence.
He also confirmed that he headed to Kasarani Police Station on the material day instead of making efforts to help Osewe.
Both Mboya and Osewe were friends before the shooting incident on December 1, 2016 ,but a love triangle involving Mboya’s wife sparked off their differences, the court was told.
