Sam Atandi explains why governors’ impeachment clause should be scrapped
Alego-Usonga Member of Parliament Sam Atandi has called for the scrapping of the constitutional clause that provides for the impeachment of governors, warning that it has become a tool of abuse and a threat to the success of devolution.
In a post published on his social media platforms on Saturday, August 16, 2025, Atandi argued that the provision is no longer serving its intended constitutional purpose. He said that instead of safeguarding accountability, the clause is now being misused to undermine governors and destabilise county governments.
Atandi maintained that members of county assemblies, driven by greed, have turned impeachment into a tool for sending county bosses home, not on the basis of proven wrongdoing but as a means of pursuing selfish political and financial interests.
He further faulted senators, who under the constitution are expected to act as quasi-judicial officers in impeachment cases, for often voting against governors unfairly. According to him, the Senate has abandoned its impartial role of listening and deliberating on the matters brought before it and instead contributed to the misuse of the process.
The legislator noted that the impeachment clause, as contained in the 2010 constitution, has weakened democracy rather than strengthened it.
He emphasised that the frequent attempts to remove governors have created instability in counties, slowed down service delivery, and diverted leaders from their core responsibility of development.
Atandi therefore wants the clause scrapped entirely, insisting that it is a threat to the success of devolution.
“The impeachment clause for governors should be scrapped. It is being abused by greedy MCAs and idle senators. The clause is a threat to the success of devolution.” Alego Usonga MP stated.

Kericho Governor’s impeachment
This comes at a time when Kericho Governor Erick Mutai has been impeached after the County Assembly overwhelmingly voted to send him to the Senate.
Out of 47 MCAs, 33 voted in favour of his impeachment, where he was being accused of abuse of office and misappropriation of public funds, among other issues.

The governor who addressed the media after his impeachment linked his woes to the assembly speaker, blaming him for using the impeachment as a tool to smoothen his 2027 bid for the gubernatorial race.
