Homa Bay Town Member of Parliament (MP) Peter Kaluma has urged the newly appointed Deputy President Kithure Kindiki to uphold impartiality and serve all Kenyans without bias.

In a statement shared on his X account on Thursday, October 31, 2024, Kaluma expressed his hope that Kindiki will lead without fear, favour, vendetta, or ill-will, as he assumes one of the nation’s top leadership roles.

The lawmaker emphasized the importance of adhering to Article 10 of the Constitution, which outlines the principles of good governance, accountability, and inclusivity in serving all Kenyans.

“New Deputy President Kithure Kindiki is to be sworn into office immediately. May he serve all Kenyans equally, without fear, favour, vendetta, or ill will!” Kaluma noted.

Adding;

“Article 10 of the Constitution of Kenya is sacred. Any breach hereof will always be punished.”

High Court ruling

Kaluma’s remarks follow the High Court’s ruling that paved the way for Kindiki’s swearing-in.

The court lifted conservatory orders that had initially blocked Kindiki’s assumption of the office of Deputy President.

The orders had been sought by former Deputy President Rigathi Gachagua, who had challenged the Senate resolution that led to his impeachment.

Justice Anthony Mrima emphasized that public interest requires the Office of the Deputy President to remain occupied.

Meanwhile, Justice Eric Ogola noted that the conservatory orders previously issued by Kerugoya High Court on October 18, 2024, have been lifted.

“We are convinced and find that the current constitutional framework does not envision any scenario in which the office of the DP would remain vacant except during the brief period required to fill a vacancy,” Justice Murima stated.

“The applications for conservatory orders are hereby disallowed. The conservatory orders on October 18, 2024, in Kerugoya High Court are hereby discharged,” Justice Ogola said.

The judges have scheduled the case for mention on November 7, 2024, and noted that Gachagua is free to file an appeal against their decision.

“The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024, in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal. Typed proceedings and certified copies of this ruling are to be availed to parties at cost. We will mention this matter on November 7, 2024, at 2 pm in the open court,” the judges said.
