The management of a beach hotel in Homa Bay has petitioned the court to suspend rehabilitation of a pier, claiming their land has been encroached on.

Homa Bay Hotels Limited moved to Environment and Land Court and accused the county government, State and Ministry of Lands and Physical Planning of encroaching on their land.

The three are listed as first, second and third respondents. Judge George Ong’ondo directed county Lands Registar and surveyor to determine boundaries in the disputed land within 50 days from Tuesday.

During the exercise, Justice Ong’ondo also directed the ward commander to provide security to the land officers who will undertake the survey.

Robert Onyango, representing the hotel, told the court that respondents allegedly trespassed on the land.

However, defendants lawyer Wilberforce Akello argued that the ongoing rehabilitation does not interfere with activities on the dry land as claimed by the hotel. Case will be mentioned on March 18.
