Gatundu South Member of Parliament (MP) Gabriel Kagombe has been released on a Ksh2 million bond or Ksh1 million cash bail and a surety of a similar amount after pleading not guilty to murder charges.

In the case filed at a High Court in Machakos, Kagombe had been accused of opening fire and killing a boda boda rider, David Nduati Wataha, in Kimuchu area in Makongeni, Thika.

Kagombe was charged after successfully undergoing a mental assessment test ordered by Justice Francis Olel on Wednesday.

“The court has considered applications by both the prosecution and defence lawyers and hereby order that the accused person be released on Ksh2 million bond or Ksh1 million cash bail and surety of a similar amount,” Justice Olel said.

The judge ordered the probation department to do a report and submit it in 30 days.

The case will be presented for mentioning on July 17, 2024.

Before the ruling, the prosecution had presented an application seeking that the MP is denied access to Thika town.

Responding to the application, the lawmaker, through his lawyers argued that he was not a flight risk given that he chairs two key parliamentary committees.

The lawyers also notified the court that he would not in any way interfere with investigations.

“So, as such, the accused person will have some troubles travelling every time coming to this court for the case. It will be inconvenient for the accused person to continue travelling to this court. He isn’t a flight risk,” one of the lawyers Brian Khaemba argued.

The court subsequently permitted the legislator to keep his travel documents.
