Court stops Orwoba’s expulsion from Senate

The United Democratic Alliance (UDA) nominated Senator Gloria Orwoba’s expulsion from the party has been suspended.
The relief comes after the High Court on Wednesday, May 21, 2025, dismissed her petition in which she had challenged her removal from the ruling party.
“I have read the notice of motion application dated 20/5/2025 filed under certificate of urgency and the supporting affidavit Gloria Orwoba sworn on 20/05/2025 and direct that that pending hearing and determination of this application, a conservatory order is hereby issued suspending the implementation of the decision of the UDA Party Disciplinary Committee dated 16/05/2025 expelling the petitioner herein as member of the UDA party and/or a nominated senator,” Justice Lawrence Mugambi ruled.
The matter has been scheduled to be heard on Tuesday, June 3, 2025.
Senate expels Orwoba
Orwoba had been expelled from the party on Wednesday, May 21, 2025, in a gazette notice by Senate Speaker Amason Kingi, who equally declared her seat vacant.
“It is notified for the general information of the public that pursuant to Article 101(2) of the Constitution of Kenya, a seat of the Member of the Senate elected under Article 98(1)(b) of the Constitution, held by Senator Gloria Orwoba, has become vacant with effect from the 21st May, 2025,” the gazette notice read.
The notice followed the High Court decision to throw out Orwoba’s petition challenging her removal from UDA. Justice Mugambi threw out the petition, citing procedural irregularities.

“I have read the Notice of Motion application dated May 19, 2025, filed under certificate of urgency and the supporting affidavit Gloria Orwoba swore on May 19, 2025, and direct as follows.
“It is apparent that the applicant has added new parties who are not in the original petition and without seeking the leave of this court to amend the petition. The Application is incompetent and is rejected. Previous directions are maintained,” Justice Mugambi ruled.
Disloyalty
Orwoba was suspended by UDA for what the party termed as disloyalty after she was seen actively involved in the homecoming rally of former Interior Cabinet Secretary Fred Matiang’i.
“Pursuant to Article 29 of the UDA Party Constitution, and having exhaustively deliberated on the matters before it, the Party’s Disciplinary Committee has resolved that Sen. Gloria Orwoba be expelled from the membership of the United Democratic Alliance (UDA) Party with immediate effect,” UDA Secretary-General Omar Hassan stated on Monday, May 19, 2025.
Hassan further revealed that Orwoba would be replaced by Consolata Wabwire from Kimilili in Bungoma County.
