Court denies Lavender Akinyi bail, rules she is a flight risk
By Zipporah Ngwatu, June 3, 2026A Milimani Court has denied a woman by the name Lavender Akinyi Ogilo bail and bond after she pleaded not guilty to preparation to commit a felony contrary to section 308(1) of the Penal Code.
According to the Directorate of Public Prosecution (DPP), Lavender was on May 31, 2026, found with dangerous weapons at Parklands Court Limited within Nairobi County in circumstances to indicate she was ready to break into a building.
The DPP states that the accused, with others not before the court, was found armed with claw bars, assorted screwdrivers, and a Y-spanner in a way that suggested that she was armed with the intent to commit a felony.
In denying Lavender bail and bond on Wednesday, June 3, 2026, Milimani Senior Resident Magistrate Irene Thamara stated that the prosecution has proved beyond doubts that the accused is a flight risk.
“The prosecution has proved beyond reasonable doubt that the accused person is a flight risk, the accused person is hereby denied bail and bond,” Magistrate Thamara ruled.
The prosecution informed the court that the accused has been previously involved in stealing, burglary and housebreaking, leading to her being arrested several times.
The court heard that in the course of investigations, the investigative officer managed to get several OB numbers where there were reports by members of the public with complaints against Lavender.
The State told the court that the reports by the complainants had been done at Kilimani police station, Gigiri police station, Parklands and Spring Valley police stations and that they are being investigated.
“Your honour, I have instructions to oppose bail on grounds that the accused person before court is a serial offender,” the prosecution told the court.
The DPP has also told the court the accused is a flight risk, and if released, she might not attend the court proceedings after it was found out that she fled to Tanzania and then to Uganda to evade arrest.
“Your Honour, the investigative officer found out the information about the accused person who went into hiding. She was located in Tanzania, and after a while, she fled to Uganda after realising the police were after her,” the State told the court.
“Your honour, if this court grants the accused person bail, she may abscond court, and also her release will jeopardise the process of recovery of the lost items that the DCI is following up with,” the prosecution added.
