Chief Registrar’s son distances himself from allegations
Brian Ochieng, the son of the Chief Registrar of the Judiciary Anne Amadi, and another advocate working in their law firm have denied involvement in the Sh100 million gold scam saying they were acting in their professional capacity as advocates.
Ochieng’ and Andrew Njenga Kiarie claim that they are strangers to the allegations made about their involvement in the gold export and gold transportation scheme as they never conspired to obtain any money as alleged by a Dubai based company.
The two are accused alongside Amadi and two others of illegally obtaining USD 742,206 from Bruton Gold Trading LLC, a company in Dubai with a promise of selling 1,500kg of gold bars in 2021.
Justice David Majanja on Thursday issued orders freezing Amadi’s, her son and two others accounts pending the hearing of the application by Bruton Gold Trading LLC, a company in Dubai.
Frivolous application
In response to the suit, the two lawyers claim that the application by the Dubai Company is frivolous, vexatious, and callous and a clear abuse of the process of the court.
“We never conspired to obtain any money from Bruton Gold Trading LLC as all the monies that were received by Amadi & Associates Advocates were in accordance with the Escrow Agreement dated 15th day of October 2021,” claimed Kiarie in an affidavit.
Kiarie said the Dubai-based company entered into an escrow agreement with the firm of Amadi & Associates advocates on October 15, 2021 after it enquired by way of WhatsApp whether the law firm was offering escrow services.
The two lawyers deny representing Universal Global Logistics Company Limited (UGL) in a transaction between the Dubai Company and UGL.
The two lawyers also denied that the firm of Amadi & Associates acknowledged liability of loss of funds as alleged by the Dubai company.
They argued that the application is premature for failing to explore clause 9.2 Arbitration being the agreed mode of dispute of resolution as provided for in the escrow agreement.
The case will be mentioned tomorrow before Presiding Judge Alfred Mabeya.
