Blow to IG Kanja and DCI Amin as court declines to suspend appearance order in Mlolongo three abduction case
Milimani High Court Judge Chacha Mwita on Thursday, January 23, 2025, ordered Inspector General of Police Douglas Kanja and Director of Directorate of Criminal Investigations (DCI) Muhammad Amin to avail themselves physically in court on Thursday, January 30, 2025.
Earlier, Justice Mwita had declined and dismissed an application made by Kanja’s lawyer Paul Nyamodi on January 17, 2025, which sought orders summoning Inspector General of Police Douglas Kanja and DCI Director Muhammad Amin to court.
Dismissing the application, Justice Mwita stated that he is not well convinced that the email address used to serve the orders were not correct.
“I’m not persuaded that the email address used was not the confirmed email address or that he was not served,” Mwita ruled.
On January 13, 2025, Mwita had ordered the IG and DDCI to be served with orders to free the three missing Mlolongo men or present their bodies personally at Milimani Law Courts in January 17, 2025.
However, on January 17, 2025, the IG and DDCI through lawyer Nyamodi told the court that they were not served with the orders leading to filling the application to have the orders removed.
Additionally, Justice Mwita stated that it is the mandate of the courts in Kenya to secure the lives of the three missing men.
“The fate of the three are unknown, securing their lives was and must remain a priority to this court,” Justice Mwita ruled.
Notably, Lawyer Nyamodi on Thursday, January 23, 2025 sought another application to dismiss the court orders even after Mwita had already declined and dismissed the previous one.
On January 17, 2025, Nyamodi told the court that the missing men were not in police custody, and could not be produced by his clients as ordered by Judge Mwita in the previous proceedings.
“There is no allegation that the petitioners are in the custody of the National Police Service but your Lordship has issued orders to the National Police Service to produce them,” Nyamodi told the court.
Kanja and Amin were summoned to court to shed light on the missing of three men in Mlolongo, Machakos County in December 2024.
