Former Deputy President Rigathi Gachagua has rejected the Ksh50 million in constitutional damages awarded to him by the High Court, saying the compensation does not address the constitutional issues raised in his impeachment case.

Speaking during a press conference on June 9, 2026, Gachagua criticised the court’s decision to uphold his impeachment while at the same time finding that his right to a fair hearing had been violated during the Senate proceedings.

“The Ksh50 million offered to me is an insult to my fundamental rights and freedom, and a mockery of the constitution; we are not interested,” Gachagua said.

The three-judge bench upheld his removal from office but ruled that the Senate violated his constitutional rights after declining to adjourn proceedings despite his illness. The judges subsequently awarded him Ksh50 million in damages for the violation.

Gachagua says case was about justice, not money

Gachagua maintained that his legal challenge was never about financial compensation, insisting that the case was focused on constitutional principles and due process.

He said the ruling raises fundamental questions about the protection of constitutional rights and the conduct of impeachment proceedings. According to the former Deputy President, the issue before the court was whether constitutional safeguards were respected throughout the process.

Gachagua has since vowed to move to the Court of Appeal to challenge the High Court findings.
