Caretaker Committee convenes meeting to change FKF constitution
Football Kenya Federation (FKF) Caretaker Committee has convened a meeting today where it is expected to change the 2017 FKF constitution.
In a letter signed by the Committee chairman Aaron Ringera, the body formed last November by Sports Cabinet Secretary Amina Mohammed, with the mandate to run all football activities in the country, after the disbandment of the local federation, has invited several stake holders to discuss and endorse a draft FKF constitution.
A number of key football stakeholders have vowed to skip the meeting, claiming that the process does not have the blessing of world football governing body Fifa.
Fifa always has to approve all draft constitutions for Member Associations before the process even hit the ground and the global body has been categorical that they don’t recognise the Caretaker Committee, whose mandate ends on May 11, raising questions on the validity of the exercise.
“The Caretaker Committee was mandated to conduct all the affairs of FKF in accordance with its constitution. In view of this, the committee has reviewed the FKF constitution and would like to facilitate a consultative dialogue with all stakeholder on Thursday April 21, 2022 at Nyayo Stadium from 9am,” Ringera wrote in part of his letter.
Section 24 (a) of the 2017 FKF Constitution stipulates that only the General Assembly has the authority to amend the constitution.
The normal procedure in changing the federation’s constitution is for the National Executive Committee (NEC) to meet and propose changes which are then sent to Fifa for approval before being sent to stakeholders for discussions, at least 60 days before a congress meeting.
The stakeholders are then expected to give their responses back to the federation secretariat 30 days before the congress meeting, then specific clauses will be deliberated on and voted for during the meeting and the new constitution sent to Fifa.
The federation’s constitution can only be amended during a Special General Meeting (SGM) or Annual General Meeting (AGM).
