Court of Appeal dismisses Wanjigi’s IEBC clearance petition
Court of Appeal sitting in Nairobi, on Tuesday, July 12, dismissed a case lodged by Safina Party presidential aspirant Jimi Wanjigi seeking to be cleared by the Independent Electoral and Boundaries Commission (IEBC) to run for president in the August 9 general election.
A 3-judge bench consisting of Justices Asike Makhandia, Kathurima M’inoti and Hellen Omondi dismissed the appeal without giving reasons.
“We shall render the reasons for our judgement on July 29, 2022,” the court said.
Hight Court dismisses Wanjigi’s case
The High Court judge Justice Jairus Ngaah had ruled that Wanjigi’s case lacked merit.
Wanjigi failed to get IEBC clearance for lack of a degree certificate.

However, in court, his lawyer Omwanza Ombati argued that the Commission for University Education (CUE) had cleared him and, therefore, IEBC was bound to accept his university documents.
The commission, however, said the transcripts were not equivalent to a degree.
Wanjigi is set to graduate at Daystar University in December 2022.
