ODPP orders prosecution of two men accused of assaulting maid

The Office of Director of Public Prosecution (ODPP) has ordered the prosecution of two men accused of assaulting a house girl in Nairobi’s Kilimani area.

Ibrahim Hussein Omar who is the Personal Assistant to East Africa Affairs PS and Ali Hussein Omar, a Kenya Power employee, are said to have assaulted a house help Miriam Atieno Okello.

The girl is said to have claimed to have been assaulted, under the guise of a family dispute.

Reported matter

She sought medical attention at Maria Immaculata Hospital and later reported the matter at Kilimani police station.

In a letter dated June 14, the ODPP said having gone through the police file and the evidence presented in it by way of witness statements, medical examination notes and the statement of the investigating officer, they found the evidence presented does satisfy the threshold required to be admitted for approval.

According to the ODPP, the Police Medical examination report (P3 Form) and treatment notes corroborated the complainant’s testimony and are sufficient enough to sustain the charge of assault causing actual bodily harm,” the ODPP wrote.

The letter signed by Dorcas Rugut, an Assistant DPP, stated: “An analysis of the P3 Form indicates that there was swelling on the head, tenderness and swellings on the right sternal area, right wrist bruising with the cause of injury being the use of hand and fist. The complainant has positively identified the assailant.”

The letter addressed to Kilimani police boss added: “You are hereby directed to have the suspects charged immediately for the offence of assault causing actual bodily harm contrary to section 251of the Penal Code.”

According to the victim, the two assaulted, tortured, and insulted her under the guise of a family dispute. They then forcibly ejected her from the premises and confiscated her personal belongings.

Police were initially accused of being reluctant to investigate the matter, prompting human rights organisations to intervene.

The victim also claimed one of the suspects took an unauthorised photograph of her and threatened to publish the photograph and accuse her of undisclosed offence.
