Kinoti disowns case seeking to stop his imprisonment
The Director of Criminal Investigations (DCI) George Kinoti has disowned a case filed in court on Friday seeking to challenge the four month jail term handed down to him by the High Court.
On the DCI Twitter handle, Kinoti distanced him self from the Judicial
case filed by city law firm, Owino McDowell and Co.Advocates.
He said he had not instructed anyone to file a suit on his behalf regarding the ruling issued by Justice Antony Mrima to have him jailed for disobeying court orders requiring him to return firearm s belonging to businessman Jimi Wanjigi.
“This is to m ake it very clear that the Director of Criminal Investigations George Kinoti has not instructed anybody to file a suit on his behalf or on
behalf of the Directorate of Criminal Investigations.
As such, the case is disowned in totality by the Director and the Directorate of Criminal Investigations,” the tweet reads.
On Friday, the law firm petitioned Milimani High Court Judicial Review Division, claiming to act for Kinoti.
It sought orders to shield him from arrest.
The case is disowned in totality by the DCI. The matter was placed
before Judicial Review Division judge Anthony Kimani Ndung’u who declined to grant the experts orders sought in the notice of motion filed by the law firm allegedly on behalf of Kinoti.
“I have considered the ap- plication. Whereas the matter is urgent given the imminent incarceration of the applicant and noting that the impugned orders are by a judge of the High Court and cognizant of the court’s jurisdiction in Judicial Review and the limitations, it is my considered view that this is not an appropriate case for grant of the sought
orders ex-parte,” Justice Kimani ruled.
He, however, directed the case to be mentioned today for further directions.
In the Judicial Review application seen by People Daily, Owino McDowell and C. Advocates is seeking orders to bar the respondents (Jimi Wanjigi and Irene Nzisa) and the interested parties (the Inspector General of Police, the Director of Public Prosecutions, the Attorney General) from arresting, interrogating and prosecuting him premised on the orders issued by Justice Mrima.
