‘It is currently beyond Finance Bill, resign’- Kalonzo to Ruto

Wiper Movement Party Leader Kalonzo Musyoka has maintained his calls for President William Ruto’s resignation over the controversial Finance Bill 2024.

Kalonzo while responding to Ruto’s decision to withdraw the Finance Bill 2024, told him to resign, stating that the matter is now beyond the controversial Bill.

In a statement shared via his official X account on Wednesday, June 26, 2024, Kalonzo pointed out that many Kenyans have already died, with many others suffering serious injuries.

Kalonzo on deadly protests

“Ruto, life is sacrosanct. Many Kenyans died. Many Kenyans suffered serious injuries. It is currently beyond the Finance Bill, 2024. #RutoMustGo,” Kalonzo said.

Kalonzo had earlier on faulted Ruto over his response to the Tuesday deadly demonstrations that saw a number of Kenyans lose theirs lives through police bullets, with many others getting injured.

Kalonzo lauds protesters

Kalonzo said it was unconstitutional for President Ruto to term the demonstrations as treasonous.

“In his Address, Ruto attempted to suspend the Constitution of Kenya by terming the rights to protest under Article 37 as TREASONOUS and our our YOUTH AS DANGEROUS CRIMINALS. He has gone further to declare Martial Law and in the process deploy the military and therefore WAR AGAINST HIS OWN CITIZENS,” Kalonzo said in a statement issued on Wednesday, June 26, 2024.

Kalonzo lauded the protesters who stormed parliament during the deadly demonstrations, stating that they were exercising their rights.

“Kenyans in their righteous anger, stormed the State captured Parliament and took back their delegated power under Article 1 of The Constitution of Kenya,” he said.

President Ruto on Wednesday, June 26, 2024, addressed the nation and announced that he was not going to sign the contagious Bill.

Ruto on withdrawing bill

Ruto said that he had arrived at his decision of not signing the Bill after reflecting on the continuing conversation around the content of the finance bill of 2024.

“Following the passage of the bill, the country witnessed widespread expression of dissatisfaction with the bill as passed, regrettably resulting in the loss of life, destruction of property and desecration of constitutional institutions.

“I send condolences to the families of those who lost their loved ones in this unfortunate manner. Consequently, having reflected on the continuing conversation around the content of the finance bill of 2024, I will decline to assent to the bill,” Ruto stated.

The tax proposals in the Finance Bill 2024 plunged the country into widespread demonstrations that have resulted in the death of several protesters with hundreds more injured.

Azimio response

In its response to Ruto’s decision, Azimio la Umoja One Kenya coalition party said Ruto had no power to withdraw a bill that had already been passed by the parliament.

“The Constitution of Kenya, 2010 in Article 94 (5) states that “no person, organ, entity or authority has the power to make law or to do anything that has the force of law other than Parliament,” the statement reads.

Azimio also pointed out that neither the President nor Parliament has the power to return a Bill for
rejection or Bill without either assent or reservations of the President.

“The power of the President to “REJECT THE BILL” and send it for fresh initiation of the Process are purported power, extra-constitutional, and not available within our law.

“If the President does not wish to sign the bill into law whether in the public interest or otherwise, the law rans its cause under Article 115 (6) in which case it becomeslaw by effluxion of time,” the Azimio statement reads.
