The Independent Electoral and Boundaries Commission (IEBC) has moved to the country’s top court to challenge the Court of Appeal and High Court decision on the Building Bridges Initiative bill. 

In its application, IEBC is challenging the Appellate court decision on the electoral body’s quorum arguing that the judgment will threaten its independence.

IEBC is also challenging the court’s decision on public participation in the push for a referendum seeking answers on its role in facilitating a plebiscite and elimination of boundaries. 

According to court documents, IEBC expressed dissatisfaction with the Court of Appeal decision arguing that the judges made a mistake in their ruling on the electoral body’s quorum.

 IEBC claims the findings by both the Court of Appeal and the High Court were based on provisions that it did not have the force of law, adding that the Appellate court relied on a nonexistent law and should therefore be overturned.
