Former MP testifies in Sh20 million land tussle
Former Keiyo South MP Daniel Ronoh yesterday told an Eldoret Court how he brokered a deal on a prime residential plot for a Nairobi-based senior Kenya Revenue Authority (KRA), that failed to go through, 14 years ago.
The market value of the said property located in Elgon View estate, where the buyer, Godfrey Ofunya Omondi wanted to construct a house, currently stands at Sh20 million.
He told the presiding Lands Court Judge Elijah Obaga that he did due diligence before linking up the buyer to Julie Kandie, owner of the property which is at the centre of a legal ownership dispute.
Ronoh confessed to the Judge that he has been brokering for his clients in need of prime plots through his company; Maestro Properties
Limited which he claimed has offices in Eldoret and Nairobi towns respectively.
Omondi, he recalled, approached him in March 2010 requesting him to secure a plot to purchase in Eldoret, a task which he undertook as he was assured of his commission after the transaction.
“There has been no issue regarding ownership of the plot as it was well known that it belongs to Godfrey Ofunya Omondi after the seller surrendered the original title deed to him in a transaction that was carried out by his lawyer,” averred Ronoh.
Ownership document
Ronoh explained that he paid Kandie Sh800, 0000 which he received from the senior KRA officer paving the way for the surrender of the ownership document.
The former lawmaker surprised the court when he said that he could not produce evidence to show that he paid the seller Sh400,000 in cash and cleared the balance of Sh400,000 through her bank account.
“Your lordship, after striking a deal for Omondi, he sent me Sh800,000 which I paid in cash Sh400,000 to the seller and balance of Sh400,000 through her bank account, but I have no documentary evidence with me to produce in court,” Ronoh told the court.
Ronoh also served briefly as Kenya Medical Supplies Authorities (KEMSA ) board chairman before he was fired by Presidency William Ruto with his entire board members over a Sh4 billion mosquito net supply scandal.
He was replaced by former Housing Principal Secretary and Farmers Party leader Irungu Nyakera.
Ronoh was testifying in a case filed by Kandie at the Lands Court where she has accused the senior KRA officer of allegedly conspiring with the land registrar in Uasin Gishu County to acquire her multi-million shillings property through fraudulent means.
When he took to the witness stand, Omondi rubbished claims by the seller that he colluded with the Uasin Gishu land registrar to acquire the title deed for the disputed property in the Elgon View estate.
Omondi told the Judge that the seller Kandie was fully involved in the whole sale process of the disputed property contrary to claims that she was not aware of anything that was going on.
Lands registry
“I entered into a sale agreement with Kandie where she willingly and voluntarily in the presence of my advocate executed the transfer of the property from her name to mine in which the transfer was lodged at the Lands registry,” stated Omondi.
According to Omondi, he paid the seller the entire agreed purchase price for the said property, while on her part; she executed the alleged transfer on or about August 30, 2010.
He pointed out that all relevant documents were lodged with the Lands
Registrar in Eldoret paving the way for issuance of title deed in his name.
Kandie has vehemently denied that she ever sold her plot to the senior KRA officer terming the whole process fraud.
Justice Obaga has directed the Land Registrar Uasin Gishu to present before his court to shed light on ownership of the said property on September 26.
