Court throws out Sonko’s bid to stop hearing
The High Court yesterday threw out a petition by former Nairobi Governor Mike Sonko seeking to stop the hearing of corruption cases filed against him.
Justice Esther Maina struck out the petition by Sonko that had challenged his prosecution in corruption cases that are ongoing at the Anti-Corruption Court in Milimani for lack of merit.
In her judgment, the judge rejected Sonko’s petition as he has since be acquitted in one of the case involving loss of Sh20 million at City Hall in December last year which had formed part of the law suit.
The former county boss had in 2020 moved to court to challenge the Director of Public prosecution and EACC’s decision to commence three corruption cases against him.
“I have considered the evidence on record and submission and found that the petition has no merit. I have also found that part of case was litigated before another petition number 38 of 2019 and would appear that petition is overtaken by events because the petitioner(Sonko) was acquitted from the charges which form the substratum of this petition. This means Sonko has to face the two corruption cases currently pending before the Anti-corruption chief court involving loss of Sh357 and Sh14 million to their logical conclusion.
In his petition, the former county chief wanted his three cases stopped on several grounds among them that his arrest and subsequent arraignment before the Anti-Corruption Court to face prosecution over corruption related charges is unconstitutional, abuse of power and the court process by the DPP and EACC hence orders to quash the decision to charge him and prohibition of further criminal proceedings. He had also challenged the decision of the Director of Public Prosecution to put some witnesses under protection claiming the same was a violating his right to a fair trial.
