Court stops further DCI hospital fraud probe

The High Court has stopped any further investigations into the operations of the Nairobi Hospital pending hearing and determination of a case filed in court.

Justice John Chigiti also stopped a move by the investigative agencies led by the DCI to block or freeze the phone numbers and bank accounts belonging to the hospital’s senior management.

The judge granted the order after the management complained that the DCI officers had taken documents and equipment containing sensitive patients’ data.

This, they said had raised serious concerns of potential compromise of patient confidentiality and a possible breach of right to privacy.

“That leave so granted do act as a stay in respect of proceedings or decision to undertake or continue investigations over all matters listed in the affidavit of chief inspector Martin Munene sworn on 20th March 2025,” the court order read.

The court further directed the police to unfreeze bank accounts of 12 board of directors of the hospital, as well as MPesa accounts, who were targeted in the probe.

Last week, Attorney General Dorcas Oduor secured court orders authorizing detectives to seize a range of documents and electronic devices from the hospital.

The search warrant issued to Chief Inspector Martin Munene granted investigators permission to search the offices of senior Management at Nairobi Hospital and Kenya Hospital Association (KHA) and cart away evidence necessary for their probe.

It also authorized an investigation into the company’s records held by both organizations.

However, in a new application filed before the Judicial Review division, KHA through advocate Gitobu Imanyara told Justice Chigiti that the actions of the DCI, IG and AG are allegedly unlawful.
