Democratic Action Party-Kenya (DAP-K) party leader Eugene Wamalwa has criticised National Assembly Speaker Moses Wetang’ula following a court ruling that Kenya Kwanza is not the majority coalition.

Wetang’ula’s decision was reversed by a ruling made by the High Court that consequently declared that Azimio la Umoja-One Kenya Alliance is indeed the majority group.

Wamalwa added that the decision on which coalition is the majority or not should be made by the voters.

“To be the majority or the minority is not the decision of Parliament or of the courts but of the people, in whom the sovereign power rests under Article 1 of our Constitution.

“We thanked the people of Kenya, including the people of the Lower Eastern Region, with whom we condoled today the passing of Daniel Kimanzi at Kwa-Vonza, for making the decision on the 9th of August 2022 that gave Azimio the majority.

“October 6th, 2022, is, however, a day that will live in infamy as the day when the worst ruling was made by the worst Speaker in the history of our Parliament, @HonWetangula, when Kenya Kwanza attempted to subvert the will of the people by declaring themselves the majority in Parliament in toto violation of our Constitution, which attempt was thwarted by yesterday’s landmark 3-judge bench ruling,” Wamalwa said in a post on X on Saturday, February 8, 2025.

Although he welcomed the ruling, the former Devolution Cabinet Secretary said the delayed judgment is akin to justice denied.

“Regrettably, the Azimio victory is a pyrrhic victory as justice is delayed by @Kenyajudiciary, which is justice denied, and it’s tantamount to shutting the stable after the two horses had fled, one in the direction of the Broad-Based Government to Okoa Zakayo and another in the direction of the Broad-Based People’s Coalition to Okoa Kenya,” he added.

2027 focus

He added that their focus is to form a coalition that he hopes will defeat President Ruto in the next election.

“This current political trajectory in the country does not change because of this historic ruling, which we welcome, but we must stay focused on building the next super alliance and next government that can rid Kenya of Zakayo and his harsh taxes, corruption, tribalism, and failed policies.

“We should focus on reversing the damage caused by the politically, artificially inseminated majority, through whose tyranny of numbers a parliamentary dictatorship was created by @WilliamsRuto to railroad through Parliament the failed, oppressive Kenya Kwanza policies and pieces of legislation that have caused grievous harm to Kenyans and made life unbearable,” he concluded.
