The court has extended to September 18  an order barring implementation of impeachment proceedings against Kisumu Finance Executive Nerry Achar pending hearing and determination of the matter.

Achar moved to court yesterday for the second time to challenge his impeachment after  Members of the County Assembly on Tuesday ousted him and asked his boss Governor Anyang’ Nyong’o to fire him.

The County Assembly and the Speaker Onyango Oloo are listed as first and second respondents in the petition filed before Employment and Labour Relations Court in Nairobi. 

Justice Maureen Onyango directed the matter be transferred for substantive hearing before a Kisumu court.

The ward reps unanimously passed a motion to kick out the Executive over claims of gross misconduct, incompetence, abuse of office and violation of the relevant laws in discharging his duties.

The MCAs had overwhelmingly endorsed an impeachment motion by the select committee chairman Steve Owiti, with 37 members voting for his removal and three against.

The Assembly had constituted a 16-member team to investigate the finance boss over the allegations levelled against him, and the committee found that the executive was culpable of the allegations,  saying  he was  unfit to hold any public office in the county.
