Six suspects accused of issuing fake title deeds have been released on bail by a Nairobi court.

Milimani Chief Magistrate Bernard Ochoi said there were no compelling reasons to continue detaining them and granted them cash bail of Sh500,000 each.

The magistrate cited Article 49 (1) of the Constitution, saying the suspects were entitled to bond.

“In this scenario, there are no compelling reasons produced before the court to deny the suspects their right,” Ochoi said.

Alleged offences

Directorate of Criminal Investigations officer Nicholas Osuri had sought to detain them longer as police investigated claims of forgery, conspiracy to defraud, making false documents, obtaining registration by false pretences and uttering false documents.

Osuri asked the court to detain the suspects for 30 days at Muthaiga Police Station to give police more time to investigate the alleged offences.

Letters of allotment

But the magistrate said the allegations against the three were not supported with documents.

Regarding letters of allotment seized from the suspects, Osuri wanted the court to grant police time to verify or trace the registered owners through the Department for Lands and Physical Planning, but the magistrate said the DCI already the documents and there was no need for the suspects to be detained.
