Prison officer reinstated after dismissal
The Commission on Administrative Justice (Ombudsman Kenya) has confirmed that a prison officer has been served with justice after a legal battle.
In a statement released on Wednesday, September 17, 2025, the Ombudsman said the mentioned prison officer has finally been reinstated following the hearing of his appeal by the Public Service Commission (PSC) after a prolonged delay in determining the matter.
The officer, Mr MOA, as described by the Ombudsman, through his advocates, complained to the Commission, citing delay by the PSC in hearing and determining his appeal against what he termed as unfair dismissal.

The statement, seen by the People Daily Digital, said, “We write to you on behalf of our client, Mr MOA, who has persistently sought justice following his unfair, unprocedural, and illegal dismissal from the Kenya Prisons Service (KPS). His appeal has not been addressed, and his plight continues to be ignored, causing him immense pain.”
“We now formally escalate this matter to the Commission for your immediate intervention. We request your office to compel the PSC to expeditiously consider and determine our client’s appeal in line with the law, investigate the failure of the PSC and KPS to accord our client a fair hearing before his dismissal, and ensure his reinstatement with full salary, benefits, and privileges from the date of wrongful dismissal,” read the letter from the law firm to CAJ.
Justice served
In the report, the Ombudsman added that the Commission took up the matter with the Commissioner General of Prisons, giving the office twenty-one days to respond.
Later in their response, the KPS informed the Commission that the officer had been reinstated.
“Reference is made to your letter addressed to the Commissioner General of Prisons. The appeal against the dismissal of the officer was allowed by the PSC, and he was reinstated to the service with effect from the date he reports back to duty.”
“The PSC further decided that the period between the date of dismissal and the date of resumption of duty be treated as leave without pay for purposes of pension,” read the letter from the Prisons Service to the Commission.
