Petitioner seeks orders compelling DCI boss to investigate issuance of IDs to Ugandans

A public benefit organisation has filed a petition at the Busia High Court seeking an order directing the Director of the Directorate of Criminal Investigations (DCI), Mohamed Amin, to investigate the issuance of national identity cards to foreigners.

The Centre for Litigation Trust, in a petition filed on Wednesday, April 1, 2026, avers that they have credible information of the irregular registration of a foreigner, Jerry Ezra Lubwana Sumba, as a Kenyan citizen.

According to the court papers, Lubwana, listed as the 1st respondent, is a known Ugandan citizen who presented himself as a resident of Mudembi Sub-location, Bunyala East, in the County of Busia, a border location with the neighbouring country of Uganda.

The organisation wants the court to compel the DCI Director Amin to immediately commence investigations on how Lubwana obtained a Kenyan ID and all those involved in the process to be prosecuted in line with Section 15 of the Registration of Persons Act.

Notably, the petitioner is also seeking an order directing the Principal Registrar of the National Registration Bureau and the Director General of the Directorate of Immigration Services to produce documents related to the registration status of Lubwana.

In addition, the petitioner is also seeking a declaration that the decision, approval and registration of the Ugandan man as a Kenyan citizen by the principal registrar of the National Registration Bureau is unconstitutional.

“A declaration that the 2nd respondent’s (Principal Registrar National Registration Bureau) decision to approve, authorise and/or register the 1st respondent (Lubwana) as a Kenyan citizen violates Articles 10, 36, 47 and 50 of the Constitution and Sections 4, 5 and 7 of the Fair Administrative Action Act and constitutes illegality, ultra vires and procedural impropriety,” part of the petition reads.

Further, they want the court to revoke or cancel his registration as a Kenyan citizen forthwith and also order the principal registrar of the National Registration Bureau to strike out his name from Kenya’s civil registration data.

“An order of MANDAMUS directing the 2nd Respondent, the Principal Registrar of the National Registration Bureau, to strike out the name and records of Jerry Ezra Lubwama Sumba of National Identity Card Number 39121075 and Serial Number 248067273 from the Kenya Civil Registration data and the Civilian Identity Card issued pursuant to the aforesaid registration being revoked and/or cancelled,” part of the orders sought reads.

According to the organisation, they received information that the Ugandan man had obtained a Kenyan ID, prompting them to write to the Assistant Chief Mudembi Sub-location, Bunyala East, seeking details and copies of documents related to his registration.

In his response dated March 25, 2026, Assistant Chief Mudembi explained that after conducting investigations, he confirmed that Lubwana is neither a resident nor hails from the said locality and that he did not sign the clearance forms for the issuance of his National Identity Card.
