The Anti-Corruption Court yesterday ordered former electoral commission chief executive James Oswago and two others to file their submissions in the Sh50 million Chickengate scandal facing them.

Milimani Chief Magistrate Lawrence Mugambi also directed the prosecution to put in their responding submissions before he fixes the judgment date.

The last prosecution witness, former IEBC tender committee chairman Mohamed Hassan, told the court that he signed the documents in relation to the tender award. He added that nobody influenced the exercise. 

In the case, Oswago (pictured) is charged alongside Hamida Ali Kibwana and Trevy Oyombra, who denied corruption charges levelled against them by the State.

Case involves bribery of poll agency officials for a tender to print ballot papers. 

Oyombra was the local agent for a UK firm, Smith & Ouzman, which was implicated in dishing out bribes, while Kibwana allegedly received the bribes on behalf of Oswago, court papers indicate.

According to the prosecution, Oswago willfully failed to comply with the law relating to procurement of goods by awarding the contract for the supply of 57,000 ballot papers for the South Mugirango by-election to Smith and Ouzman.

This was in contravention of the Public Procurement and Disposal Regulations 2006.

He allegedly committed the offence on May 7, 2010 at the Interim Independent Electoral Commission offices in Nairobi.
