Nyoro walks free as cops fail to charge him

Kiharu MP Ndindi Nyoro got a reprieve yesterday after he was freed by the court for lack of a prosecution file.

The MP had appeared in a Murang’a court in the morning as he had been directed by the police on Monday evening.

Nyoro was accompanied by MPs Alice Wahome (Kandara), Gichimu Githinji (Gichugu), Murang’a Senator Irungu Kang’ata  and a host of MCAs.

The embattled MP appeared before resident magistrate Sheila Nyaga, who said since no case had been presented before her, the matter could not proceed.

Prosecution counsel Sabastian Mutinda said they had not received the MP’s file and thus could not charge him.

“We do no have his file and we were not aware that we are supposed to charge him,” he said. 

The prosecution also opposed an application by Wahome to have Nyoro given an anticipatory bond saying it would be pre-emptying the matter.

Legislator released

The MP was arrested on Monday evening by a contingent of  GSU officers from Nairobi and had been booked in at Kamukunji Police Station in Nairobi before being released a few hours later.

Nyoro demanded an official communication from the court showing charges levelled against him had been dropped.

Kang’ata, one of the lawyers representing the MP, said they were exercising caution as the promise to drop the charges against Nyoro may have been a trap  to set  him up.

Speaking outside the court, Nyoro said his arrest was not warranted  and  was only meant to intimidate him.

“How do you send 150 GSU officers to arrest one person? What big crime had I committed?” he posed.

He claimed there were plans to harm him, saying two criminals had been put in the cell where he was to be locked up.

“The way I was being handled was clear that the officers were acting on orders from above” he said.

Wahome accused the police of being mischievous, saying she could not understand why they would order Nyoro to appear in court and fail to present his file.
