An aspirant in Lamu County has written to the Chairman, National Lands Commission objecting to the allocation of 1707 Hectares of Land to US energy firm Cordisons International for Wind Power Project.
Josphat Musembi Matei argues the allocation of the said land to the US firm is unprocedural, irregular and clear violation of the constitutional rights of the local communities who have live in the said land for many years.
He says the land in question is inhabited by more than 1000 squatters including indigenous communities, farmers, and fishermen among others.
“The land in question is a crucial source of economic activity to the locals who practice farming, fishing, grazing among other activities,” he says in the letter to the National Land Commission.
NLC in a gazette notice dated March 16, stated that it intended to allocate the said Land to Cordison International Limited for industrial purposes.
This was to be done subject to terms and conditions and reservation which would be included in the conveyance documents in accordance with section 14 of the Lands Act 2012.
“Anybody wishing to raise any comments may do so to the Chairman National Land Commission within n 30 days from the date of the publication of this notice,” read the gazette notice.
According to the commission, the absence of a valid objection, the allocation shall take place at the Commission’s office on the next working day following the expiry of the notice.
The Lamu west MP, aspirant however in his objection, argues that local communities and the squatters have preoccupied the said land for many year and that the said Land was the only place that they dwell and practice economic activities.
“As a consequence of the said allocation, the local community and the squatters shall suffer irreparable harm, loss and damages,” he said in the letter received by NLC on April 1.
