Kingi outlines schedule for Governor Guyo ouster trial
Senate Speaker Amason Kingi has gazetted two days for Isiolo Governor Abdi Guyo’s impeachment trial.
This even as Guyo’s defence team prepares to challenge the move by the county assembly to defy a court order not to proceed with the impeachment motion.
The defence team, led by former Law Society of Kenya (LSK) President Eric Theuri and Elias Mutuma, is burning the midnight oil to prepare responses should the Senate reject their preliminary objections.
The embattled county chief is facing charges of gross violation of the Constitution and other laws, abuse of office, and gross misconduct.
Kingi gazetted Tuesday, July 8, 2025, and Wednesday, July 9, 2025, for the trial after senators resolved to hear the matter in plenary.
However, questions have emerged whether the county assembly adhered to standing orders and existing laws.
In addition, Guyo is challenging the process, especially after the court barred the county assembly from proceeding with the impeachment motion.
This is after an initial notice of motion was introduced in the assembly on June 10, which prompted Guyo to obtain court orders halting any impeachment proceedings.
Subsequently, on June 18, the assembly introduced what appeared to be a fresh motion—an apparent attempt to circumvent the court orders.
However, reports indicate that the MCAs neither sat in the official assembly chambers nor gazetted an alternative venue when introducing the new motion.
Initial motion
“If they sat in the Isiolo chambers, then they should produce video evidence showing the withdrawal of the initial motion, the introduction of a new one, the debate, and the resolution to invite the governor to defend himself,” a source familiar with the developments said.
Despite the court order, 16 of the 18 MCAs convened on Thursday, June 26, 2025, and voted unanimously to impeach Guyo.
The governor, who was reportedly invited to respond to the allegations, has denied receiving any formal communication from the assembly.
Meanwhile, Isiolo County Assembly Speaker Mohammed Koto and the Assembly Service Board have suffered a major setback after the High Court overturned their decision to suspend Clerk Salad Gurcha.
Justice Onesmus Makau of the Employment and Labour Relations Court, sitting in Nyeri, issued a temporary order halting the suspension, pending the determination of a petition filed by Gurcha.
“An order is hereby granted, temporarily, suspending the respondent’s decision to place the applicant on compulsory leave,” ruled Justice Makau on Tuesday.
Gurcha was suspended on June 16, 2025, over alleged financial impropriety, absenteeism, failure to submit requisitions for April and May to the Controller of Budget, and poor coordination of management meetings.
