Kigomo Mwaura charged with attempt to defraud 2 women of Ksh150M Westland land
By Zipporah Ngwatu, May 18, 2026A businessman, John Kigomo Mwaura, has been charged with conspiracy to defraud two ladies of a maisonette located in Westlands in Nairobi valued at Ksh150 million.
Appearing before Milimani Principal Magistrate Geoffrey Onsarigo on Monday, May 18, 2026, Mwaura has also been charged with forgery, making documents without authority, uttering forged documents, trespass and obtaining land registration by false pretences.
The businessman who was to be charged alongside Abdisalan Adan Hussein, who was not in court, has pleaded not guilty to 12 charges lodged against him by the Directorate of Public Prosecution (DPP).
According to the charge sheet, the two are alleged to have conspired to defraud Sabahatt Shokatali Habib and Sadaff Shokatali Habib on April 29, 2019, of the said maisonette by falsely registering a lease document for the said parcel of land.
Request for reasonable bail terms
Kigomo, through his lawyer, has urged the court to release him on reasonable bail terms.
The court heard that he is elderly and that he has been unwell, and him remaining detained, his health will continue to deteriorate.
“Your honour, my client has been unwell, and his health is deteriorating daily. We urge the court to grant him reasonable bail and bond terms so he may continue receiving treatment,” Kigomo told the court through his lawyer.
However, state prosecutor and complainants’ lawyer Paul Macharia has vehemently opposed the bail and bond application by the accused.
The court heard that the accused had repeatedly failed to appear before the court, even despite being summoned multiple times.
“The accused was issued court summons on several occasions but was never found. He was eventually arrested. If released on bond, he will abscond. He faces 12 counts of serious offences,” the prosecutor submitted.
Magistrate Onsarigo has denied the businessman bail and directed the investigating officer to prepare a probation report before the court can consider granting bail or bond terms.
The court has also extended a warrant of arrest against Kigomo’s co-accused, Abdisalan Adan Hussein, who is still at large and being sought by DCI detectives.
The matter will be mentioned on May 20, 2026, for further directions.
