Isabwa tells court he is wrongly charged with the murder of former Kabete MP
Eric Isabwa, alias ‘Chairman’, has told the court that he is wrongly charged in the murder of former Kabete Member of Parliament (MP) George Muchai.
Appearing before Milimani High Court Judge Kanyi Kimondo on Tuesday, March 10, 2026, Isabwa stated that he is not supposed to be in court pertaining to that case.
“Mheshimiwa, nataka kuambia hii koti kwamba hii case nimeletwa nayo hapa sikufaa kushtakiwa na hii case,” Isabwa submitted.
In his defence, Isabwa has also informed the court that he was arrested on February 15, 2015, while at his place of work at Marikiti Market in Nairobi and booked at the Central Police Station.
He has said that he was arrested along with other people in the market, and they were booked with robbery with violence charges at the police station.
The accused proceeded to tell the court that after they were locked up in cells, at around midnight, he overheard police officers who were along the corridors saying that they had been given 72 hours.
“Mheshimiwa, baada ya hapo, hiyo siku, kitu saa sita ya usiku kwa corridor, nilisikia officers wakisema kwa Kiswahili, ‘Boss wetu ametupee 72 hours. ‘Nilikuwa kwa cell wakiwa kwa corridor, and I didn’t know what they were meaning,” Isabwa added.
Isabwa vehemently denied being arrested at Margaret Njeri Wachiuri’s house, who was one of the accused persons in the murder but was later acquitted.
The accused insisted that he was arrested while selling tomatoes at the Nairobi Marikiti Market, a business he had inherited from his parents 12 years ago when they passed on.
He told the court that evidence of the date of his arrest linking him to the murder was not produced in court.
Isabwa denied the evidence of the arresting officer, Singila, who, according to him, testified in court that he had arrested him on February 13, 2015.
“Seargent Singila amekua akitoa ushahidi wake akisema alinishika 13/2/2015; mheshimiwa nimekua nikiambia wakili wangu aulizwe baada ya kunishika alinipeleka police station gani na hajakua akisema,” Isabwa told the court.
“Hakuna OB alileta kwa hii koti kuonyesha alinishika hio siku. Aliendelea kusema alinipeleka Nairobi area na hakuna kitu ya kudhibitisha matamshi yake,” Isabwa added.
Notably, he told the court that he had his own evidence, an OB that he would like to be marked as his defence.
“Mheshimiwa, hakuna dhibitisho ya siku nilishikwa kwa hii koti, na pia nikona dhibitisho yangu 51/2015/2, na nikimalizia ningeomba hio OB ikue marked kama defence witness yangu,” Isabwa added.
During cross-examination, the prosecutor told the accused to confirm he was not calling any of the people he said he was arrested with at the Marikiti market.
In his response, he said he had none among the people he had been arrested with to call as a witness.
He also said that this was not his first time being arrested, noting that he had been arrested previously.
