High court certifies Tuju’s application urgent, grants him Ksh200K anticipatory bond

A Nairobi High Court has certified former Cabinet Secretary Raphael Tuju’s application as urgent.

Milimani High Court Judge Martin Muya directed on Tuesday, March 24, 2026, that the matter be heard during the court vacation due to its urgency.

Judge Muya has also granted Tuju an anticipatory bond of Ksh200,000 with an alternative of paying a cash bail of the same amount.

“That the applicant is hereby admitted on an anticipatory bond of Ksh200,000 with one surety or cash bail or similar amount,” Judge Muya ordered.

The orders come after Tuju filed a certificate of urgency seeking to be admitted to anticipatory bail pending the hearing and determination of his application, dated March 24, 2026.

In the application filed at the Milimani High Court Criminal Division, Tuju was also seeking orders restraining the presence of police officers beside his hospital bed.

Tuju wanted the Inspector General of Police (IG), the Directorate of Criminal Investigations (DCI) and the Directorate of Public Prosecution (DPP) to keep off his hospital bed.

“That this honourable court be pleased to issue an order directing the respondents (IG, DCI and DPP), their agents and servants to immediately cease and desist from maintaining any physical presence or guard over the first applicant (Tuju) at his hospital bed and allow him to receive medical treatment free from unlawful restraint, intimidation or custodial interference,” part of the application reads.

Further, the former CS also wants the court to issue an order restraining the IG, DCI, DPP and all other officers subordinate to them from arbitrarily summoning, arresting, incarcerating and interfering with his freedom of movement in relation to interactions with them.

Earlier, Tuju’s lawyers informed the Kibera Magistrate Court that he had been rushed to the Karen Hospital today for treatment after sustaining injuries while at the Karen Police Station.

The former Cabinet secretary was slated to plead to a charge of giving false information to a person employed in public service before Kibera Chief Magistrate Stellar Atambo on Tuesday, March 24, 2026.

Justice Muya has directed that the application be served to the respondents (IG, DCI and DPP).

The matter will be mentioned on April 7, 2026, for further directions.
