Havi announces plan to legalise bhang in Kenya

Former Law Society of Kenya (LSK) President Nelson Havi has continued to champion for the leglisation of Marijuana. 

In a statement shared on Sunday, March 30, 2025, Havi declared that he will file a constitutional petition to declare as unconstitutional all sections of the law criminalizing the growing, processing, sale and use of the drug. 

“I will in the next coming week file a constitutional petition to declare as unconstitutional all sections of the law criminalizing the growing, processing, sale and use of marijuana. We must level the vibes,” he said.

Initially, Havi had issued a statement wondering why Marijuana was criminalized yet it was a naturally growing plant given to man by God. 

“I have never understood the criminalization of marijuana. It is a naturally growing plant that Jah gave to man,” he said at the time. 

His sentiments were backed by former Roots party presidential running mate Justina Wamae who wrote; “Thanks so much for spreading the gospel.” 

The debate over the legalization of bhang has taken centre stage over the years with some Kenyans calling for the legalisation of the drug. 

Section 3 (2) (a) of the Narcotic Drugs and Psychotropic Substances Control Act lists cannabis as a banned substance. 

It also affirms that cultivation, use and dealing in Marijuana is illegal and if one commits an offense relating to the drug is liable on conviction to a fine of not less than one million or imprisonmeny of a term not less than five years or both.
