Lawyer Jane Njeri Maina has told a three-judge bench hearing former Deputy President Rigathi Gachagua’s case that the National Assembly did not conduct any civic education on his impeachment.

Njeri, who is also the current Woman Representative for Kirinyaga County, has also stated that there was no prior sensitisation on the subject matter, a process that is necessary.

In her submissions before Justices Eric Ogola, Freda Mugambi, and Antony Murima on Thursday, May 7, 2026, lawyer Njeri also averred that the August House did not follow the law in the impeachment process.

“My lords and my lady, the National Assembly should have conducted impeachment proceedings of his excellency Rigathi Gachagua within the confines of the law, not outside of them,” lawyer Njeri, representing a third petitioner, submitted.

Njeri argues that the public participation was not adequate and cannot be considered a qualitative and quantitative exercise.

According to Njeri, it was stated that there was an orchestrated systematic exclusion in various constituencies, and some of the offices remained closed, arguing that it was not accidental but intentional, as it was planned.

Notably, she noted that there was no material evidence accompanying the allegations against the former DP Gachagua.

In addition, she stated that there was no opportunity provided to the Kenyan people to seek clarification on issues raised on the forms provided by the National Assembly as the template for public participation.
