Four trespass suspects detained for two days

Four suspects alleged to have encroached on a five -acre land belonging to a prominent leader  in Karen were yesterday detained for two days pending interrogations.

They are Mohammed Muhammud Wako alias Hussein Mohammed, James Owino Opere, Jonah Saluni Tuuko and Samakin Lesingiran.

Milimani Magistrate Jane Kamau allowed the Directorate of Criminal Investigations’ request to continue holding the four  at Muthaiga Police Station until Friday 11am.

In her ruling, Kamau said there are no compelling reasons to detain them for seven days.

“Having looked at all the material placed before me l order the four be detained for only two days and will be released on Friday at 11 am upon deposit of  Sh30,000 cash bail each.

They will be reporting to the station daily pending the probe,” order Kamau.

In an affidavit filed in court, DCI declined to disclose the name of the prominent leader, saying it is because of security reasons.

“It would be appropriate to investigate the motive behind the forcible entry noting that it is a property of a prominent leader, due to security reasons, I wish not to disclose his name,” the application.

But lawyer Danstan Omari representing Opere and Saluni informed the court that his clients were told that the said land belongs to the Head of State.

“Your honour, my clients have told me that they were told that the land belongs to the Head of State. That is why they are here,” Omari stated.

The lawyer, while opposing the request by the State, urged the court to release the suspects on reasonable bail terms pending the on going probe.

Omari also told court that his clients were only passing by the land and didn’t trespass as alleged by the State.
