The Land and Environment Court in Eldoret is scheduled to deliver a landmark judgment in the ownership of a Sh200 million property, pitting a prominent businessman and company associated with Nominated Senator Margaret Kamar and her daughter.

Justice Elijah Obaga has settled on March 14, the day he will deliver the verdict on who the legal owners of the two prime parcels of land measuring in total 50.3 hectares.

Wilson arap Maina, the plaintiff, has been battling in the corridors of justice for the last six years with the Senator and her daughter Maria Soti over the ownership of the multi-million shillings suit property.

Maina, the younger brother of the late former State House Comptroller Abraham Kiptanui, took Kamar and her daughter to court for refusing to transfer to him the two prime parcels of land he bought from them through his company Kobilo Farm Limited six years ago.

The disputed parcels of land are located in Moiben sub-county, Uasin Gishu along the Eldoret-Iten highway are Sergoit/Koiwoptaoi/13/9 measuring 36.7 hectares and Sergoit Koiwoptaoi/14/4 measuring 13.6 hectares.

In his testimony before Justice Obaga, Maina said he entered into a sale agreement with the duo on July 9, 2018 where they agreed to sell to him the parcels of land.

He said he had fulfilled his part of the bargain after paying Sh194 million and remained with a balance of Sh6 million which he was set to clear upon the defendants surrendering the said suit property to his company.

Maina told the court that the defendants, however, refused to transfer the property to him, thus forcing him to move to court to seek legal redress.

While defending herself in court, Kamar dismissed as untrue claims by Maina that she had gone against the transaction agreement and instead accused him of refusing to pay the balance.
