Court stays ruling on Tuko News contempt pending case hearing
Tuko News yesterday got a reprieve after the High Court stopped contempt proceedings against it over a story published online concerning the National Youth Service (NYS) graft scandal pending the hearing of the suit.
Justice Esther Maina issued the orders following an application by the online news platform challenging the orders of magistrate Eunice Nyutu to compel it through its editor Didacus Malowa to publish an apology over the alleged misreporting of the case in March.
“In the meantime, the proceedings against the applicant (Tuko news and its Editor Malowa) in the lower court have stayed pending the hearing of the application,” Justice Maina said.
The judge also ordered the Director of Public Prosecutions Noordin Haji to file his responses and the lower court proceedings that led to the sentence of the online platform editor by close of business yesterday.
The stay of contempt proceedings against Tuko news comes days after the judge last week ordered the immediate release of Editor Malowa from Kamiti Maximum Security Prison.
