A Nairobi court yesterday dismissed an application by Michael Macharia, popularly known as DJ Brownskin who is facing charges of aiding suicide of his wife to have DCIO Kasarani Jimmy Kimaru summoned to appear for disobeying court orders.

In his ruling, Milimani Chief Magistrate Lucas Onyina dismissed the application, saying it should have been filed at Makadara Law Courts where the first case was registered.

“This court cannot interfere with Makadara court’s matter, for that reason I dismiss the application,” said Onyina, directing the case to be mentioned this morning for bail application.Through lawyer Duncan Okatch, DJ Brownskin had also alleged police were forcing him to admit the offences as pre-condition for his release.

Okatch had asked the court to issue orders compelling the DCIO and the investigating officer in the matter to appear in person to explain why they have failed to comply with an order issued last week to release the accused from custody.

The court heard that though the accused was granted Sh50,000 cash bail, the police are yet to release him.

“On June 9, 2023 in blatant disrespect of the court orders, the DCIO Kasarani and investigations outright declined to release the accused person on the face of the original court order over the weekend. On Monday the police extended the non-compliance and rushed him to court for plea,” Okatch told the court.

The lawyer further stated that during the interrogation, the officers tried to force DJ Brownskin to confess in exchange for his freedom.

Detectives also revealed that DJ Brownskin shared the video of Njeri ingesting the poisonous substance with a lover living abroad.

The alleged girlfriend then shared the video with an unidentified blogger who published the video in April.

Njeri is said to have died between July 29 and 30, last year.
