Court extends orders against implementation of Finance Act

The government has suffered a significant blow as the Finance Act 2023 is put on hold pending the hearing and determination of the case challenging the legality of the new tax law.

In a ruling delivered by Milimani High Court Justice Mugure Thande, the court has extended orders suspending the implementation of the Finance Act 2023 until the case by Busia Senator Okiya Omtatah and six others is heard and determined.

Justice Mugure has also found the case raises serious constitutional issues that require determination by more than one judge.

She however referred the suit to Chief Justice Martha Koome to empanel a bench to determine the matter.
