Blow to Sifuna as tribunal declines to block ODM disciplinary proceedings against him
The Political Parties Disputes Tribunal (PPDT) has declined to issue conservatory orders blocking Orange Democratic Movement (ODM) proceedings against Nairobi Senator Edwin Sifuna emanating from a notice to show cause letter.
The tribunal, led by acting chairperson Gad Gathu, stated on Thursday, April 9, 2026, that they cannot stay the party’s internal process, thus allowing the ODM to proceed with tomorrow’s disciplinary process.
However, the Tribunal has barred the party from reaching any conclusion from the disciplinary process on Friday, April 10, 2026, until the current application filed by Sifuna is heard and determined.
“To ensure fairness, we will not stay any internal process; we hereby stay any determination until the tribunal delivers a ruling, so we will not stay the process, but we stay the determination of the processes,” Gathu directed.
Sifuna, through a certificate of urgency application filed on April 7, 2026, sought to have the Tribunal issue an order temporarily blocking the disciplinary proceedings scheduled for Friday, April 10, 2026.
This was after the party wrote a notice to show cause letter to him to appear before a disciplinary committee over allegations of misconduct made against him that led to the party’s National Executive Committee (NEC) resolution to remove him as the Secretary General (SG).
When ODM appeared before the tribunal, their legal team, led by lawyer Samuel Makori, informed the tribunal that the Internal Dispute Resolution Mechanism (IDRM) process was already underway.
The party vehemently opposed Sifuna’s request to stay the disciplinary process, urging the PPDT to allow them to continue with the process that they have already started.
“Your honour, we are opposed to any form of stay, and we urge the Tribunal to let the party continue with its process,” ODM lawyers told the Tribunal.
“It will be very wrong to have the Tribunal interfere with the IDRM process, and you (PPDT) do not have any jurisdiction to issue stay orders regarding this matter as it stands now,” the ODM legal team submitted.
The Tribunal has set April 20, 2026, for hearing the application.
