10 members of Sowesava, Soweto Jua Kali charged afresh with malicious damage to property in Donholm

Ten people alleged to be members of Sowesava Self-help group and Soweto Jua kali have been charged afresh with malicious damage to property and forcible entry to a piece of land in Nairobi’s Donholm Estate belonging to Gidjoy Investment Limited while armed with crude weapons in 2018.

The 10 are; Benita Alando Nathanel, Peter Keya Owino, David Mutuku Makau, Kennedy Odhiambo Alex, Titus Ochieng Okoth, Boniface Oduor Anyiego, Calvince Ochieng Ooko, Patrobas Awino, Nick Omondi Owango and Philemon Otieno.

They were charged afresh after the prosecution amended the charge sheet and added another count of forcible entry.

In March 2018, they had been charged with maliciously damaging Gidjoy Investment perimeter Wall valued at Kshs 144 Million at around 0100 hours at Donholm Estate.

In the added forcible entry count, they are accused of entering the said parcel of land the property of Gidjoy Investment in a violent manner by chasing away security guards while armed with crude weapons.

The offense allegedly happened on 24 th May of 2018 at Donholm Phase 8 in Embakasi Sub County jointly with others who were not before Court.
Principal Magistrate Gilbert Shikwe directed that they be released on earlier set bail terms of Sh 20,000.

The case which was coming for hearing did not however proceed after their lawyer George Gilbert argued that there was addition of information that he was not familiar with since charge sheet had been amended.

“I will ask for another date so that I can familiarize myself with the new charge,” he said.
Mark Munge the Operations Manager at Gidjoy Investment Ltd was set to continue giving his evidence in chief.

The case will now be heard on November 2,2021.
