UDA serves Khalwale with show-cause notice over supporting rival candidate in Malava by-election
The United Democratic Alliance (UDA) Party has issued a show-cause notice to Kakamega Senator Boni Khalwale over cited misconduct during the Malava Constituency by-election campaigns.
In a letter dated October 9, 2025, referenced UDA/15/DISP/25, and signed by Charles Njenga, Chairperson of the UDA Disciplinary Committee, the party accuses Khalwale of openly supporting a candidate from a rival political party.
“The Disciplinary Committee of the United Democratic Alliance (UDA) Party is in receipt of information and evidence of your various political activities, utterances and associations… widely circulated in the media,” the letter reads in part.

Party questions senator’s loyalty
The party cites the senator’s “open, vocal, conspicuous and substantial” support for the opposing candidate as a clear indication of promoting a position against UDA’s interests.
According to the letter, such conduct is contrary to the expected behaviour of party members as outlined in the party’s constitution and code of conduct.
“These include, but are not limited to, your open support and participation in the campaigns of a candidate from a different political party who is competing with the UDA candidate in the scheduled by-election for Member of Parliament, Malava Constituency.

“Your support for the said opposing candidate has been open, vocal, conspicuous and substantial as to clearly demonstrate that you are promoting a position that is against your own party’s interest and therefore acting outside the expected conduct of a member of the UDA party as expressly provided for in its constitution and code of conduct.”
Breach of party code
UDA further states that Khalwale’s actions amount to disloyalty and gross misconduct. The committee states that the senator’s support for the rival candidate “constitutes conduct unbecoming and disloyalty to the United Democratic Alliance Party… which nominated you for election to the office and position of Senator of the Kakamega County.”
The letter references Article 75 of the Constitution of Kenya, the party’s code of conduct, and Khalwale’s oath of office as the basis for disciplinary action. It also points to Article 4 of the party constitution, which obligates members to popularise the party and maintain discipline.
This development comes amid Khalwale’s open support for DAP-K candidate Seth Panyako in the upcoming Malava by-election, a move that has placed him at odds with his own party, UDA, which has fronted David Ndakwa for the seat.
Khalwale has earlier defended his stance, saying Panyako represents the “genuine interests” of Malava residents and should be supported over leaders “imposed by external forces”.
Khalwale given 14 days to respond
The disciplinary committee has directed Khalwale to respond to the allegations within 14 days. “You are hereby required to show cause why appropriate disciplinary action should not be taken against you and further why the sanctions provided in the said party constitution should not be imposed against you,” the letter states.
The senator has also been informed of his right to self-representation or legal counsel during the disciplinary process in accordance with Article 68(p) of the party constitution.
