‘Decision to rule on majority hinges on post-election arrangements’ – MP Joseph Makilap says as chaos rocks parliament over majority party

The Member of Parliament for Baringo North, Kipkoros Joseph Makilap, has waded into the heated debate over which party holds the majority position in Parliament, cautioning the speaker against rushing to rule on a matter that the courts have already deliberated on, basing their decision on past agreements.
Makilap made his remarks in Parliament on Tuesday, February 11, 2025, amid heightened chaos as members of the Azimio la Umoja coalition and the Kenya Kwanza alliance clashed as each faction aggressively pushed to be recognized as the majority.
The legislator was among a lineup of Kenya Kwanza MPs who disrupted proceedings as they scrambled for speaking opportunities, asserting that the court ruling favouring Azimio was anchored on an agreement signed back on August 9, 2022, immediately after the August 8, 2022, general election.
According to him, the courts failed to take into account the post-election political shifts, particularly the defection of members from parties like Jubilee and UDM to Kenya Kwanza.
He argued that the determination of the majority should reflect the current composition of Parliament rather than a static assessment based on outdated agreements.
“This decision was frozen at the moment of August 9, 2022, right after the elections, based on what was called a pre-election coalition agreement. However, after we were sworn in, post-election agreements also came into play. This means that the composition of Parliament, in terms of party affiliations, is a dynamic, ever-shifting reality shaped by evolving interests among MPs and the coalitions they choose to align with,” he stated.
