Senate leader of the Majority, Senator Aaron Cheruiyot has called out coastal governors for issuing executive orders banning the transportation, distribution and sale of Muguka.

In a statement on Monday, May 27, 2024, the Kericho Senator insisted the governors have no power to place an embargo on muguka in their areas of jurisdiction.

Mombasa Governor Abdulswamad Sherrif was the first county boss to ban the popular stimulant leaf followed by his Kilifi counterpart Gideon Mungáro and now Taita Taveta Governor Andrew Mwadime.

However, Cheruiyot insisted that their executive orders are out of order.

“It’s a noble thing for the coastal counties to seek to regulate the distribution of muguka in their turf,” his statement read in part.

“However, the truth is counties have no such powers.”

Cheruiyot’s advice

Cheruiyot opined that the ban can only become law if it is implemented through the legislative route. He reached out to the three governors asking them to lobby for support from lawmakers from the region to introduce a bill in parliament seeking to declare muguka a dangerous drug.

According to Cheruiyot, proper deliberation in both houses would inform a proper decision over their plan to save the coastal people from muguka addiction.

“The best thing is for the counties to lobby their MPs to present before parliament a bill seeking to ban the use of muguka,” he insisted.

Nassir on why he banned muguka

On Monday, May 27, 2024, Governor Nassir explained that he declared a fight against the sale, supply and consumption of muguka, across the county due to its availability and the ravaging effects.

Speaking on a local radio station, the first-time county boss lamented that the leaf stimulant is readily available in Mombasa. He further linked muguka to mental issues in the county.

When asked why he has not placed an embargo on heroin, Nassir maintained that his county has no powers to search all containers to detect the drug.

“I have no power to get into the containers that come in from the port. I have no power to search people who are getting into our aircraft into Kenya. I have no powers to put people at international border posts because heroin is not grown locally,” he stated.
